Officer to be Tried in Louisville

A judge on Tuesday refused to move the murder trial of a fired white police officer charged with fatally shooting a black teenager in the back.

Mattingly was indicted in March on charges of murder and wanton endangerment. He pleaded not guilty and was freed on bail.

He has been fired for violating the department's use-of-force policy by shooting Newby three times in the back.
