Moments for a Prosecutor to Drool Over

The last statement made by the defendant on direct examination:
. . . but I'm not guilty this time!"

    Q: Why haven't you paid your fines?
    A: I don't work & my husband's disabled.
    Q: What's the nature of your husband's disability?
    A: Oh he's not....he's just lazy and sorry.

  2. I can't tell you the number of times a client has wanted to use this as a defense when I was a public defender: Listen, I pled guilty every other time I was arrested. Since I am not pleading guilty this time, that should be proof that I didn't commit the crime.
