Even though the county's 22 criminal district court judges have asked him to recuse himself and the foreman of a grand jury has asked him to recuse himself, the Houston prosecutor refuses to let a neutral party step in to conduct the investigation of the misconduct at the DNA lab and its possible implications as to his own office.

Ted Poe, a district judge in Harris County who supervises one of the grand juries: "All we know is that two grand juries are investigating the DNA lab here. Both are bringing in witnesses and both have not requested help from the district attorney and both have not said why. It's very unusual."

"Judge Poe said that the grand jury he was overseeing "wants to operate independently of the district attorney. They have made that very clear.""
The prosecutor and members of his office have been subpoenaed to appear before the grand juries.

What ever fail-safes are in place in Texas need to kick in and get this guy out of the investigation of his own office.
