Malvo's lawyers are trying to get his trial in Virginia precluded because he was charged in federal court and Virginia law prohibits prosecution after federal charges are filed on the same crime.

This is interesting and innovative. It won't work but it is a fresh angle. The judge will rule that the charges are different and therefore the law does not apply.
